In the state of Texas, there are a few things that need to be done prior to filing for divorce. First, you or your spouse will need to prove that either of you have been a resident of the state of at least six months. You will need to show that one of you has resided in the county in which you plan to file for divorce for at least 90 days. You will also need to work with an attorney who can help determine whether you will need to request a temporary restraining order against your spouse. Texas does allow no-fault divorces; however, there are grounds for divorce that you may choose to pursue.

What are the Fault Grounds in a Divorce Case? Divorce Notification

Abandonment – You must prove that your spouse left you for at least one year prior to filing for divorce.

Adultery – It is up to the discretion of the court to grant divorce under adultery, and an attorney can help prove this fault.

Confinement in a Mental Hospital – If your spouse will be confined in a mental institution for at least three years, you may be able to file for divorce.

Conviction of a Felony – In addition to a conviction, confinement in a penitentiary for at least one year or a felony that has not been pardoned can be grounds for divorce.

Cruelty – Cruel and unusual or inhumane treatment could be grounds for divorce if you can prove that the marriage is insupportable.

Insupportability – Under no-fault laws, this is the most commonly filed grounds for divorce in the state of Texas. It shows that the marriage has broken down past the point of reconciliation.

Living Apart – If the spouses have been living apart for at least three years, this may be the right option for you to cite in your divorce.
